This Privacy Policy describes how we collect, use, disclose, and protect your information when you use ellise and any related websites, apps, content, and services (collectively, the "Service"). It also explains your privacy rights and how the law protects you.

We use your Personal Data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

2. Interpretation and Definitions

Interpretation

The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

  • Account means a unique account created for you to access our Service or parts of our Service.
  • Application refers to ellise, the software program provided by the Company.
  • Company (referred to as either "the Company", "we", "us" or "our") refers to ellise.
  • Country refers to Maharashtra, India.
  • Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
  • Personal Data (or "Personal Information") is any information that relates to an identified or identifiable individual.
  • Service refers to the Application and any related websites, content, and services.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company (for example, analytics or cloud hosting providers).
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service.

3. Information We Collect

Personal Data

While using our Service, we may ask you to provide certain Personal Data that can be used to contact or identify you, such as:

  • Email address
  • First name and last name
  • Phone number (if you choose to provide it)
  • Any other information you choose to share with us (for example, preferences, feedback, or messages)

Usage Data

Usage Data is collected automatically when using the Service. This may include information such as your Device's IP address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. When you access the Service by or through a mobile device, this may also include information such as the type of mobile device you use, your mobile device's unique ID, your mobile operating system, and the type of mobile Internet browser you use.

4. How We Use Your Personal Data

The Company may use Personal Data for purposes including:

  • To provide, operate, and maintain our Service.
  • To power AI-driven features, including outfit recommendations, style advice, image generation, and related functionality.
  • To manage your Account and your registration as a user of the Service.
  • For the performance of a contract, including development, compliance, and undertaking of any purchase or other agreement with you.
  • To contact you by email or other electronic communication regarding updates, security alerts, or information related to the Service.
  • To provide you with news, special offers, and general information about products, services, and events similar to those you have already used or requested, unless you opt out.
  • To manage your requests and support inquiries.
  • To monitor and analyze usage to improve our Service, features, and user experience.
  • For business transfers, such as evaluating or conducting a merger, acquisition, or sale of assets.
  • For other purposes such as data analysis, identifying usage trends, and evaluating the effectiveness of our marketing.

When required (for example, before sending your photos or prompts to third-party AI providers), we request your explicit consent inside the app. You can withdraw your consent to our AI data processing at any time by deleting your account in the app or contacting us at admin@ellise.ai. When you withdraw consent, we will stop sending your new data to our AI providers and will delete your account and associated Personal Data, except where we are required by law to retain certain records. Withdrawing consent may mean you can no longer use some or all of the AI-powered features of the Service.

5. Cookies and Similar Technologies

We may use cookies and similar tracking technologies to monitor activity on our website and store certain information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, some parts of the Service may not function properly without cookies.

6. How We Share Your Personal Data

We may share your Personal Data in the following situations:

  • With Service Providers: to operate, monitor, and analyze the use of our Service, provide customer support, process payments, and deliver core functionality (including AI features).
  • For business transfers: in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business.
  • With affiliates and business partners: where necessary to operate the Service, provided they honor this Privacy Policy.
  • With other users: if the Service offers public areas, information you share in those areas may be visible to others.
  • For legal reasons: if required to do so by law or in response to valid legal requests by public authorities (e.g., a court or government agency).
  • With your consent: in any other situation where you have given us your consent.

We require any third party with whom we share Personal Data to provide the same or equal protection of your data as described in this Privacy Policy and as required by applicable data protection laws.

Third-party AI service providers

To provide outfit recommendations, style advice, image generation, and related AI features, ellise sends certain data to third-party AI providers that process this data on our behalf. Because the Application is AI-powered, these providers are necessary for the core functionality of the app. If you do not consent to this AI processing, you will not be able to use the app, although you can still access our public website.

Depending on how you use the app, this may include:

  • Text you type in the app (for example, chat messages, prompts, and style descriptions).
  • Photos you choose to upload (for example, body photos for try-on, wardrobe photos, outfit reference images).
  • Basic technical and usage data (for example, device type, app version, coarse location, language, and in‑app event logs) necessary to operate, secure, and improve the Service.

We currently use the following AI providers:

  • OpenAI – Used to generate and refine text-based style recommendations, chat responses, and internal planning outputs.
  • Google Gemini (Google LLC) – Used to generate, analyze, and refine style, outfit, and image-related content.
  • Grok – Used to assist with fashion and style reasoning and to help generate outfit ideas and descriptions.
  • BFL (bfl.ai) – Used to generate outfit images (including try-on or reference-based images) from your prompts and the photos you choose to upload.

These providers process your data only to provide services to ellise and for their own safety, security, and abuse-prevention purposes. We do not authorize them to use your data for their own independent advertising or marketing. Where required by law, we will request your explicit consent before sending your Personal Data to these AI providers, and you may withdraw your consent as described in this Privacy Policy.

Search and product discovery services

To help you discover products visually similar to garments in your outfits, ellise uses a third-party search API:

  • SearchAPI.io – Used to perform Google Images–style searches for fashion products and looks, based on textual descriptions of garments and outfits. We send search terms derived from your prompts and AI-generated garment descriptions, along with basic technical data (such as IP address, device type, and user agent). We do not send your raw uploaded photos directly to SearchAPI.io.

Subscriptions and in‑app purchases

We use a third-party subscription platform to manage your ellise Pro subscription:

  • RevenueCat – Used to manage subscription status, entitlements, and receipts across platforms (for example, iOS and Android). RevenueCat receives data such as your app-specific user identifier, in‑app purchase receipts, and basic device information. We do not send your photos or chat messages to RevenueCat.

Authentication providers

If you choose to sign in with a third-party account, we share limited information with those providers to authenticate you:

  • Google Sign‑In (Google LLC) – If you choose “Continue with Google”, we receive your Google account ID, email address, and, where available, your name.
  • Sign in with Apple (Apple Inc.) – If you choose “Continue with Apple”, we receive an Apple‑provided user identifier and, where available, your name and email address.

These authentication providers do not receive your chat messages, outfits, or photos from ellise. They use the shared information only to authenticate you and to comply with their own legal and security obligations.

7. Retention of Your Personal Data

We retain Personal Data only for as long as necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (for example, for tax, accounting, or legal obligations).

In general, we apply the following approach:

  • Account information: kept for the life of your account and for a reasonable period after closure to handle post-termination issues and disputes.
  • Support data and communications: kept for a limited period after the interaction to improve service, resolve follow-up inquiries, and defend against potential legal claims.
  • Usage data and logs: kept for a limited period to improve the Service, troubleshoot, and ensure security.

When data is no longer needed, we will delete it or anonymize it so that it can no longer be linked to you. Backup copies may be retained for a limited period in secure storage for disaster recovery and security purposes.

8. International Transfers

Your information, including Personal Data, may be processed at our operating offices and in other locations where Service Providers are located. This means your information may be transferred to and maintained on computers located outside your state, province, or country, where data protection laws may differ from those in your jurisdiction.

Where required by applicable law, we will ensure that such transfers are subject to appropriate safeguards so that your Personal Data remains protected in line with this Privacy Policy.

9. Your Rights and Choices

Depending on your location and applicable law, you may have rights such as the right to access, correct, update, or delete your Personal Data, the right to object to or restrict certain processing, and the right to data portability.

You can exercise these rights by contacting us at admin@ellise.ai. We may ask you to verify your identity before responding to your request. In some cases, we may be required or permitted by law to retain certain information even after you request deletion.

10. Delete Your Personal Data

You have the right to request deletion of Personal Data that we hold about you. Our Service may provide tools to delete certain information directly. You may also contact us to request that we delete Personal Data we hold about you. We will delete or anonymize your Personal Data unless we need to keep it for legal, security, or legitimate business reasons.

11. Disclosure for Legal Reasons

The Company may disclose your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation or respond to valid legal requests.
  • Protect and defend the rights or property of the Company.
  • Prevent or investigate possible wrongdoing in connection with the Service.
  • Protect the personal safety of users of the Service or the public.
  • Protect against legal liability.

12. Security of Your Personal Data

The security of your Personal Data is important to us. We use reasonable technical and organizational measures to protect your Personal Data. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

13. Children's Privacy

Our Service does not address anyone under the age of 16. We do not knowingly collect personally identifiable information from anyone under the age of 16. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us so that we can take steps to delete such information.

14. Links to Other Websites

Our Service may contain links to other websites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third party sites or services.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top of this page. In some cases, we may also notify you by email or by a prominent notice in the Service. Changes are effective when they are posted on this page.
